ZNEX® warrants its products to be free from defects in material and workmanship under normal use by the customer for a period of one (1) year from purchase (the “Warranty Period”). All warranty claims by the customer shall be made to ZNEX® at 2121 Maple Pravado, Ontario, CA 91761. Replacements shall not interrupt or prolong the term of this Warranty.
ZNEX®’s obligation under this Warranty is limited to either the repair or replacement of the product, at its sole option, where a defect has been claimed during the Warranty Period, and which is returned, freight prepaid, to ZNEX® at the address given above. Upon inspection by ZNEX®, the tool or parts thereof which prove to be defective will be repaired or replaced at no charge; or if agreed upon, refund the purchase price, less a reasonable allowance for depreciation, in exchange of the product.
THE WARRANTY SENT FORTH ABOVE IS EXCLUSIVE AND NO OTHER WARRANTY, WHETER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED. ZNEX® SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
The warranties set forth herein apply only to the original customer and are conditional upon the customer giving prompt notice to ZNEX® of any discovered defects during the Warranty Period. ZNEX® shall not be responsible for any other defects or damage, including, but not limited to any defects or damage caused by or resulting from: (a) alterations to the tool by any one other than ZNEX®; (b) accident; (c) abuse or negligence; (d) normal wear and tear; (e) use as a rental unit; or (f) failure to use in a safe and reasonable manner. If the tool, in the judgment of ZNEX®, shows evidence of having been altered, modified or serviced without the authorization of ZNEX®, the warranties set forth herein shall not apply.
ZNEX®’s cumulative liability for damages of any kind whatsoever and regardless of the form of action, whether in contract or not, including negligence or strict liability, shall be limited to the purchase price of the tool that caused the damages or that is the subject matter of, or is directly related to, the cause of action.
IN NO EVENT SHALL ZNEX® BE LIEAVE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR FOR ANY INFORMATION, DATA OR COMMERCIAL LOSSES FROM ANY CAUSE, INCLUDING DAMAGES CAUSE BY THE TOOL, WHETHER OR NOT ZNEX® HAS RECEIVED NOTICE OF THE POSSIBILITY OR CERTAINTY OF SUCH DAMAGES OR LOSSES.
This warranty gives you specific legal rights and you may also have other legal rights which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
